Marina’s Use Of Association Common Ground

At the Quarterly Members Meeting on 4/9/22, Marina owners Eric and Jean Rohal and several members voiced their displeasure with the board’s enforcement of no overnight parking on common ground in the area north of the marina property. This area has been used for the last several years to stage boats before and after service by the marina.

The owners of the marina came to the board in 2021 with a proposal to lease the land that is defined as Lot 395 – which comprises some of the areas in which boats have been stored for the last several years mentioned above. The proposal suggested that the land would be used to stage boats before and after repair and potentially used to stage boats for sale. That proposal was not approved by the board, mainly because there is a Rule and Regulations in place.

Rule 2.F.4 states “The parking area immediately to the north of the Marina is limited to Members only and may not be used for boat repair or boats awaiting service at the boat repair shop”.

The board has been working to develop a path forward to resolve this issue with the parking area that many members are passionate about. After a great deal of discussion this week, we have decided that we need further clarification of Rule 2.4.F as one could interpret the rule in a way that would allow the marina to park boats there AFTER repairs are performed. This interpretation would still result in a lack of clarity regarding overnight parking on that particular piece of property.

Article XV of the ILPOA By-Laws states: “No Common Ground shall be sold without this issue being presented and discussed during at least two (2) Special Meetings of Members in good standing.”

Let this serve as official notice that we will hold a First Special Meeting on Saturday, May 7th at 9:00 AM to discuss the potential lease of a portion of Lot 395 to the Owners of the Marina. We intend to hold a Second Special Meeting on Sunday, May 8th at 9:00 AM to satisfy our By-Law requirements. We are required to give 20 days’ notice for a special meeting which we are satisfied with this communication.

 Our intent once we hold these meetings is to mail out a special vote to the members to clarify Rule 2.4.F and to vote on leasing a portion of Lot 395 to the Marina owners.
