September 30, 2020Legal Update (9/30/20)
The Legal update below was provided by Chris Painaire, Legal Chair. If you have any questions for Chris you can email him at bod.cpinaire@ilpoa.org.
- Lawsuit with Brunts, Wideman, O’Fallon, Williams: Count V was dismissed by request of the plaintiffs. The case has been entered into final judgement within Crawford County, but an appeal has also been filed in the Missouri Court of Appeals, Southern District by the plaintiffs. The community is awaiting the next steps in the appeal process. It could be another 45 days before documents and transcripts are turned over to the Court of Appeals (this is the responsibility of the plaintiffs). As more information is known, it will be shared with the community.
- The case against All-Type Fence is ongoing. We are scheduled for court on 10/28/20 at 9am CST. Our team is currently building the case to prepare our attorney for court.
- ILPOA has several nuisance properties within the community that the Board is taking legal action. Filings are in process. Additionally, the ILPOA has sent proposals to members that are severely overdue in dues and fees to forfeit their lot-only properties over to the association in exchange for relief of their dues/fees. If this is something you as an owner are interested in, please reach out to the office at indianlake@ilpoa.org or bod.cpinaire@ilpoa.org.
