Nuisance Property Procedures

The ILPOA Compliance and Rules Enforcement Committee (aka CARE) is responsible for identifying non-compliant Indian Lake properties (aka nuisance properties ) per ILPOA BUR,  by-laws, and rules & regulations and utilizing the allowable ILPOA citations, fine and legal processes to encourage corrective behavior. Any suggestion that a property be labeled as a “nuisance property” must be verified by at least two CARE Committee members prior to citation, fine or legal action taken against it.

Upon being verified as a nuisance property, the citation and fine process per Section 12, Violation, of ILPOA rules & regulations will be promptly initiated. Each nuisance property citation will clearly state a time period expectation for meaningful compliance improvement if not compliance completion. Absent a CARE Committee approved plan submitted by the nuisance property owner, or a CARE Committee devised plan successfully communicated to the nuisance property owner, the initial nuisance property citations will allow 30 days for meaningful compliance improvement if not compliance completion. Failure to meet the compliance expectations of the initial citation or the approved plan for compliance will result in additional nuisance property citations, issued approximately every two weeks. Prior to a 3rd citation being sent to a nuisance property owner, the ILPOA CARE Committee Chair or his / her designate will counsel with the ILPOA Legal Chair ( or his or her designate ) to consider and develop potential legal proceedings for continued non-compliance of the noted nuisance property. Said legal procedures may include the removal of the CARE Committee’s interaction and oversight of the noted nuisance property.

The CARE Committee will maintain a file of all verified nuisance properties and their citation and fine status.
