Inappropriate Signs/Flags

08/05/21

Dear Members:

Recently we’ve been contacted by our community regarding signs/flags some of which have foul language that is certainly not appropriate for our family-friendly community.  As we begin to address these situations we wanted to make you aware of how our governing documents and Missouri statutes address these situations:

  • Building and Use Restrictions of Indian Hills Property Association (5) states that  “No noxious or offensive trade or activity shall be permitted on any lot, nor shall anything be done there on which shall be or become an annoyance or nuisance to the neighborhood……No signs of any kind shall be displayed in any lot without the written permission of Indian Hills.”
  • Missouri statutes ( 442.404 ), such sign restrictions, including flags restrictions, cannot place restraints on political signs displayed in support of or in opposition to a person seeking elected office or a ballot measure.

Therefore, let it be known that tasteful, non-vulgar political, patriotic, real estate, property identification and improvement, and approved neighborhood initiative signs, banners, and flags are approved exceptions to ILPOA Building and Use Restrictions ( BUR ) 5.  .  The identification of signage not included in the noted exceptions will be at The ILPOA Board of Director’s sole discretion.

To give our members adequated notification to ensure compliance, beginning 8/16 (Monday) ILPOA will address violations that do not meet these guidelines as outlined in our ILPOA Rules and Regulations by issuing citations and/or fines.  If you have any questions about whether your signage/flags meet these guidelines you can send a picture and explanation in an email to the ILPOA Office at indianlake@ilpoa.org and one of our Board members will follow up with you.

Thank you for your cooperation,

ILPOA Board of Directors
