06/17/20 Legal Update from Mary Beth Huffman, ILPOA President

Members:

As most of you are closely following Case 19CF-CC00003 Indian Hills Civic Association with plaintiffs Brunts, O’Fallon, Wideman and Williams vs Indian Lake Property Owners Association (defendant), we have an update.

Last week, Judge Kelly Parker ruled in our favor to the legal portion of the case that included the Bridge Assessment, Boat Stickers, Fines and Interest.

Their attorney stated in court that the four plaintiffs are still seeking their attorney fees and punitive damages against your Association through Counts IV and V of the suit.  Our lawyer, Bianca Eden appeared in court today to plead a dismissal of those charges.  Judge Kelly Parker is taking this under advisement.

We are aware of the keen interest of our members wanting to move this community forward.  We will keep you advised as we learn information.
